§ 6.04.110. Noise from animals.

  • A.

    It is unlawful for any person to permit any animal which he or she owns, keeps or cares for within the city, to disturb the peace and quiet of any neighborhood by barking, howling or yelps. A dog which barks, howls or yelps in a manner which causes annoyance to any person(s) other than the owner, shall be deemed a public nuisance upon the filing of a complaint with the police department.

    B.

    In addition to the prohibitions set out in subsection A of this section, it is unlawful for any person to permit any animal which he or she owns, keeps, or cares for to repeatedly or continuously bark, howl, or yelp in a manner which can be heard from off his or her premises between the hours of eleven p.m. to seven a.m.

    C.

    In the event a complaint is filed with the police department charging that a dog is disturbing the peace and quiet of another person(s) while within the confines of the private property of such dog's owner or keeper, then the police department shall issue a warning and direct the owner or keeper of such dog to abate the nuisance immediately. Should such dog continue to be a nuisance and a complaint is again filed with the police department, then the owner or keeper of such dog shall be subject to the penalty in Section 6.04.120 of this chapter.
