§ 6.04.120. Penalty.

  • A.

    The penalty for violation of this chapter shall be:

    1.

    Fifty dollars ($50.00) for the first offense;

    2.

    One hundred dollars ($100.00) for the second offense;

    3.

    One hundred fifty dollars ($150.00) for every offense thereafter.

    4.

    If a dog has been classified as a Class B or Class C animal, according to Subsections 6.04.140.A(2) or (3), in lieu of a fine the owner may choose to send the dog out of town or kill such dogs and to dispose of the remains at the city dump.

    5.

    Any dog that has been classified as a Class B or Class C animal (at any time in the dog's history) according to Subsections 6.04.140.A(2) or (3), shall be impounded by the city and either sent out of town or killed and the remains disposed of in the city dump; the owner shall have no right to redeem such dog.

    B.

    If an owner fails to meet any of these duties, the owner will be subject to a civil penalty of two hundred dollars ($200.00).
