§ 3.12.070. Award of contract to lowest qualified bidder; local preference.

  • A.

    Contracts shall be awarded to the lowest qualified bidder. In determining the lowest qualified bidder, in addition to price, there shall be considered:

    1.

    The ability, capacity and skill of the bidder to perform the contract;

    2.

    Whether the bidder can perform the contract within the time specified, without delay or interference;

    3.

    The character, integrity, reputation, judgment, experience and efficiency of the bidder;

    4.

    The quality of performance of previous contracts;

    5.

    The previous and existing compliance by the bidder with laws and ordinances relating to the contract;

    6.

    The sufficiency of the financial resources and ability of the bidder to perform the contract; and

    7.

    The number and scope of conditions attached to the bid.

    B.

    If otherwise in full conformity with the invitation for bids, a local bidder who meets all requirements shall be considered as low bidder if its bid is the lesser of five percent or forty thousand dollars ($40,000.00) in excess of the lowest bid received from a non-local bidder located elsewhere in Alaska, or the lesser of ten percent or eighty thousand dollars ($80,000.00) in excess of the lowest bid received from non-Alaskan bidders.

    1.

    A local bidder is a bidder with its primary place of business located in the city.

    C.

    When the award is given other than to the lowest bidder, a full and complete written statement of the reasons therefor shall be delivered to the unsuccessful low bidder or bidders and filed with the other papers relating to the transaction. The minutes of the council relating to the matter may be used as the required written statement.
