§ 6.04.060. Police have authority over loose dogs.

  • The chief of police, his or her patrolman, or any other person granted authority so to act by the council, shall have the power and authority to confine and/or dispose of any loose dogs within the city as follows:

    A.

    Any loose dogs within the city shall be captured, if possible by the authorities set forth herein, and confined for a period of three days from the date of capture. If no person claims the dog within that period of time, the dog shall be sent out of town to an adoption facility, killed, or sold to the highest bidder, but no dog shall be sold for less than fifteen dollars ($15.00). If the dog is claimed by its owner within that period of time, it may be released to the owner upon payment to the city of the sum of five dollars ($5.00) per day for each day that the dog is impounded, such charge to cover the cost of the capture, care and feeding by the city.

    B.

    It is recognized that it may not be possible to capture all dogs that are loose within the city. Therefor, if after diligent effort and failure to capture such dogs, the authorities are authorized to kill such dogs and to dispose of the remains at the city dump. If such dog is found to be wearing identification, the owner shall be notified that the dog has been disposed of as a public nuisance. If the dog is not wearing such identification, notification shall not be necessary.

    C.

    The city may construct and maintain adequate and humane quarters according to the standards of the city for the confinement of dogs impounded under the provisions of this chapter. Proper provision shall be made for regular feeding and watering and humane treatment in general.
