§ 5.04.030. Hours of closure.

  • A.

    Licensed premises within the city shall remain closed between two a.m. and ten a.m. on weekdays; and between five a.m. and ten a.m. on Saturdays and Sundays. Restaurants which are designated as licensed premises within the city may be open during the above hours of closure for the purpose of serving food to the public; however, such restaurants shall not sell, barter, give, consume or dispose of alcoholic beverages to any person during the hours of closure.

    B.

    With the exception of patrons of restaurants designated as licensed premises, no person other than the licensee, his or her agent, employees, or peace officers who are acting within their official capacity, shall enter or remain upon such licensed premises within the city, during required hours of closure.

    C.

    Licensed premises within the city shall remain closed on each day on which a statewide special, primary, or general election is held, or a local option election or a local election is held for the purpose of voting for a candidate for public office until the polls are closed. Restaurants which are designated as licensed premises may remain open on an election day for the purpose of serving food to the public; however, such restaurants shall not sell, barter, give, consume, or dispose of alcoholic beverages to any person.

    D.

    The hours of operations are extended for any licensee or licensed premises within the city for special events as follows:

    E.

    A licensee may make application and receive permission for extended hours of operation for days or events not set forth in subsection D of this section. Any such application shall be submitted in writing to the city council sufficiently in advance of the event or day to permit the city council to schedule and advertise a public hearing upon the application. At such a hearing the licensee must appear personally or, if a corporation, through an officer duly authorized to appear, to testify in support of the application. A representative of the Galena police department shall be present at the hearing and if he or she requests an opportunity to be heard, shall be called to testify.
